Summary: It analyzes what is the "criminal law" desired by netizens in contemporary social media. The research is important for contextualizing the punitive discourse on the current network society, in which the behavior and social reality show is different from the past. Bibliographical sources and online journalistic material (social media) will be used to respond to the following question: there is a "criminal law" desired expressed by Internet users in Brazil? Having this "criminal law", which the media influence to the formation of discourse? Scientific research is relevant to be made on the eve of the promulgation of the new Criminal Code (PLS No. 236/2012, currently pending in the Senate), notably austere, giving voice to public opinion arising out of social media. Thus, by sample survey, analysis enables bring aspects of "criminal law" desired on the Internet. Delimitation analysis is given to a lynching occurred in July 2015 in São Luís-MA. Is analyzed all the articles published by online newspaper Extra/Globo on the subject (lynching), in nine days - time span in which all the materials and comments were published. The assumption is that "criminal law" desired currently is the same that applied in the distant past: corporal punishment. A Critical Discourse Analysis provides immersion in the research problem, along with the use of theoretical lenses linked to criminology, the media and the network society. In this sense, there is the confirmation of the hypothesis: the dominant discourse in the comments of Internet users are directed to a "criminal law" more punitive (discursive legitimacy to the practice of private revenge and corporal punishment). However, this discourse can not be considered in isolation, because was noticeable the media influence in the formation/deformation of the discourse of the netizens, when positioned in a way (predominantly informative matter) or other (opinionated or biased content).
