Summary: The present work analyzes the Adequacy of Conduct Agreement as a legislative technique created by the public Civil action (Law nº 7.347/85), with the objective of implementation of the right to an ecologically balanced environment. This is an instrument created according to the needs of the Democratic Constitutional State, to guarantee respect for the right material. In this sense, it is essential to analyze his structure and limits set for its celebration. As a pratical conclusion, hypotheses are presented involving the Adequacy of Conduct Agreement, as well as those that do not have legal autorization. In addition to the materials rules, procedural rules are showed, as proposed the possibility of inclusion of legal agreement procedure, provided for in the new Code of Civil Procedure, all with the objective of more effective protection of the environment and specifically, the native vegetation of the Atlantic forest.
