Summary: This study has the purpose of analyzing if the administrative authority has the possibility to challenge the constitutionality of specific laws when judging on administrative processes. Critical analysis has been done based on certain problematic situations caused by the administrative praxis that comes down to not analyzing the constitutionality of laws when applying to the cases. It has been done a research concerning the origins of the judicial review and the possibility to apply it to the administrative process field. This paper presents the possibilities the administrative judge has when analyzing the suits and the defendant's right related to constitutional guarantees concerning the due process of law and the principles of legality, morality, effectiveness and public interest.
