Summary: This thesis seeks, beginning by the presentation of some concrete cases that were judged by the jury of Vitoria/ES, to analyze how jurors react when faced with witnesses and circumstancial evidence, particularly with regard to greater or lesser tendency to acquit or convict in different situations. Thus, the research investigates in a literature and legal practice perspective, if there are some kind of evidence that jurors overestimate, which one and what leads jurors to that valuation.
Keywords: evidence; witness; circumstancial evidence; criminal procedure.
