Summary: This research analyzes the impact of the use of generative artificial intelligence (GenAI)
on the cooperative model of Brazilian civil procedure. Linked to Research Area 2 of the
Graduate Program in Procedural Law at the Universidade Federal do Espírito Santo, it
investigates, within the framework of contemporary constitutionalis, searching the extent
to which the incorporation of these automated tools impacts the shaping of Brazilian civil
procedure as an instrument for adequate and effective judicial relief oriented toward the
protection of substantive rights. Based on the premise that the dissemination of readily
accessible models among judges and parties strains the dogmatic foundations of the
cooperative model and poses risks to procedural integrity, the study employs a deductive
methodology to defend the hypothesis that preserving procedural justice in this new
context requires an interpretive update of the structural norms of the adversarial principle
and good faith. It seeks to demonstrate that the effectiveness of the automated process
depends on the systematization of legal criteria capable of safely guiding the use of GenAI
by both the judiciary and the parties within a framework of risk-responsive governance.
