Summary: This research was conducted by the Master’s Program in Procedural Law at the Federal
University of Espírito Santo (UFES), within the concentration area of Justice, Procedure and
Constitution, under the research line of Justice Systems, Constitutionality, and Protection of
Individual and Collective Rights of the LABCODEX research group. The study aims to analyze
the systematization of treaties on international legal cooperation adopted by the Ibero-American
Community of Nations (CIN), specifically from the Conference of Ministers of Justice of IberoAmerican Countries (COMJIB) and the Ibero-American Network for International Legal
Cooperation (Iber@red), with special emphasis on the dialogue and bilateral relationship
between Bolivia and Brazil. Within COMJIB, despite the existence of several cooperation
treaties, their application between Bolivia and Brazil remains fragmented and asymmetrical due
to the lack of adherence or ratification of these treaties, as well as differences in each country’s
institutional cooperation practices, which hinder cooperation and the operability of
transnational justice. Adopting a descriptive-qualitative approach and a deductive technique,
the study analyzes the doctrinal foundations of international legal cooperation and the essential
elements of the treaties adopted by COMJIB and Iber@red, subsequently projecting them onto
the bilateral relations between Bolivia and Brazil. As a result, it is found that a systematization
of the Ibero-American normative corpus of treaties on legal cooperation will strengthen
relations between the two countries: first, by proposing the ratification of technological treaties
(Medellín, Mar del Plata, Cybercrime), and then by improving their practical application within
the conventional framework of each legal system, evaluating their impact on the bilateral
cooperation relationship. The literature review and normative analysis revealed that, despite the
existence of several treaties and an institutional structure rooted in the Ibero-American sphere,
the cooperation treaties adopted by COMJIB and Iber@red have not been fully ratified or
incorporated into the respective domestic laws of Bolivia and Brazil. The research thus develops
a systematizing proposal that organizes and clarifies the normative corpus of the treaties, in
order to facilitate their analysis and application once the pending ratifications are completed,
providing legal criteria that strengthen the performance of competent legal authorities,
particularly in the bilateral cooperation relationship that exists between both jurisdictions.
