Summary: The subject of this dissertation is the third-party impleader, a form of third-party intervention
that objectively and subjectively expands the scope of the claim, and through which the third
party is bound to the outcome of the proceedings while simultaneously filing an advance claim
for security against them. This subject is closely linked to the PPGDIR's area of concentration
because it deals with an interventionist procedural technique that protects the patrimonial right
to security. The problem relates to the current context of the third-party intervention system and
the antithesis observed in the classic forms of intervention. The starting point was the problem
of establishing a doctrinal-jurisprudential overview of joinder of a third party in the first decade
of the 2015 Code of Civil Procedure's validity. The deductive method was used, starting from
previously accepted general premises, relating them to specific premises and, through logical
reasoning, formulating successive conclusions. The research involved a literature review and a
systematic and analytical examination of repealed and current legislation, as well as an
examination of rulings from the Superior Court of Justice. The systematization concluded that
the matter of third-party notice remains fundamentally based on the previous Code of Civil
Procedure, with a misunderstanding that generates resistance to its admission in certain
situations, notably due to a lack of clarity regarding the functions and scope of the intervention.
The research contributes to improving the use of the third-party impleader technique, providing
it with systematicity and describing its operation and applications. It proposes a structuring
from an interpretative perspective that aims for greater security to encourage its use and
contributes to the building of a more efficient system, harmonious in its decisions and effective
in handling multiple conflicts. Ultimately, it is about understanding the third-party impleader
as a procedural technique designed to promote, with greater coherence and efficiency, the
jurisdictional protection of related legal relationships brought before the court.
